SAN DIEGO, CA (June 9, 2023) – Today, Firearms Policy Coalition (FPC) announced the filing of a Ninth Circuit response brief in its lawsuit that secured a preliminary injunction against most of the California Unsafe Handgun Act (“UHA”). The brief in FPC’s Renna v. Bonta case, along with other case documents, can be viewed at FPCLaw.org.
“The district court did not abuse its discretion when it preliminarily enjoined the UHA’s three core ‘feature’ requirements that effectively ban the retail sale of modern handguns that are in common use throughout the Nation,” argues the brief. “This decision was compelled by the Supreme Court’s decision in Bruen and well within the court’s discretion. Plaintiffs seek to purchase off-Roster handguns for self-defense and other lawful purposes. This conduct is surely covered by the ‘plain text’ of the Second Amendment and is therefore ‘presumptively protect[ed]’ by the Constitution.”
“California’s Unsafe Handgun Act turns the very concept of constitutional rights on its head by banning all handguns unless and until they are deemed ‘not unsafe’ under an arbitrary set of standards set forth by a hostile legislature,” said FPC Director of Legal Policy Bill Sack. “As the District Court has already acknowledged, the state does not have the power to unilaterally limit the available market of handguns to a paltry fraction of the arms protected by the constitution.”
FPC is joined in this lawsuit by Second Amendment Foundation, San Diego County Gun Owners PAC, and Citizens Committee for the Right to Keep and Bear Arms.
